Terms and Conditions
All contracts for the sale of products by Diana Shop to third parties (the Customers) are governed by these General Conditions of Sale.
Purchasing on our website implies reading, understanding, and accepting these General Conditions.
Diana Shop may modify, at any time and without prior notice, the content of the General Conditions set forth in this document: such modifications will be effective from the date of publication on the website.
The terms of sale applicable to the order are those in force on the date of the order itself.
Products purchased on www.dianashop.it are sold directly by Diana Di Florio (hereinafter referred to as the OWNER) with registered office in Italy, Via Selvapiana, 84 66043 Casoli (CH).
1. PURCHASE PROCEDURE
To conclude the online purchase contract on www.dianashop.it, you must confirm, after adding one or more products to the cart, the cart order summary in electronic format, and by confirming it, it will be transmitted to the Owner, electronically, following the relevant instructions. The order summary contains information on the essential characteristics of each ordered product and its relative price (including all applicable taxes or duties), the payment methods you can use, and shipping costs.
Before proceeding to confirm the products in the cart, you will be asked to carefully read the General Conditions of Sale, the Privacy Policy, and confirm your acceptance by selecting the corresponding field.
The receipt of the order by Diana Shop will be confirmed by an automatic response sent to the Customer's email address. This automatic confirmation only implies the receipt of the order by the Owner and not the conclusion of the contract. The contract will be considered concluded with the acceptance of the order by the Owner.
Diana Shop has the right to accept or not accept, at its discretion, the order sent by the Customer, and may not process orders that do not provide sufficient guarantees of solvency, or are incomplete or unavailable, without the latter being able to make claims or rights of any kind, including compensation, in case of non-acceptance of the order itself. In these cases, we will inform you by email within 24/48 hours that the contract has not been concluded and that the Owner has not proceeded with your purchase order, specifying the reasons.
2. ONLINE PRODUCT PRICES
Product prices are clearly indicated on the website and are understood to be VAT included, with the exception of some cases outside the Italian territory.
Exceptions:
- For access to the website and/or shipments to non-EU countries, the displayed product prices will be VAT excluded. Not subject to VAT (Article 8, Presidential Decree 633/72)
- For access to the website and/or shipments for EU companies with a VAT number (excluding Italian companies), the displayed product prices will be VAT excluded. EU companies will be liable for VAT payment in their country. Not subject to VAT (Article 41, Legislative Decree 331/93)
For countries exempt from VAT payment, additional costs (customs duties) may be charged before the conclusion of the contract.
Product prices may be subject to updates. Please ensure you check the final selling price before submitting the relevant order form.
Diana Shop will consider valid the selling price in force at the time the order is sent by the customer.
3. IN DIANA RETAIL STORES
Prices, promotions, and all initiatives indicated on the dianashop.it website are valid exclusively online.
Customers who wish to take advantage of these initiatives by collecting the goods at the retail store can complete the order online and choose in-store pickup.
4. IN-STORE PICKUP
In-store pickup can take place immediately after order confirmation. It will not be possible to try on the item, only to pick up the packaged parcel. The conditions for exchange and return will be those in force on our online shop.
5. PRODUCT COLORS / IMAGES
The images and colors of the products offered for sale on www.dianashop.it may not correspond to the real ones due to the Internet browser and monitor used.
Diana Shop does not provide any guarantee regarding the exact correspondence between the image depicted on the website and the actual product.
6. PRODUCT AVAILABILITY / SHIPPING COSTS
Product availability on our website www.dianashop.it is updated in real-time; however, it is not excluded that in the event of numerous simultaneous orders, the actual availability of individual products may vary significantly from the availabilities reported on the website.
In this case, Diana Shop does not guarantee the certainty of fulfilling the delivery of products purchased and indicated as available on the website, and therefore it will not be held responsible under any circumstances.
In such a case, Diana Shop will promptly notify you by e-mail, within 24/48 hours of your order confirmation, of the unavailability of the products.
In the case of payment made for a product that is no longer available, the owner will refund the amount already paid by you within 24/48 hours after payment.
The refund will be made via bank transfer (provide IBAN) or via PayPal.
FREE SHIPPING IN ITALY FOR AMOUNTS OVER €99
Shipping costs vary based on the delivery and payment method, shipping location, and the total order amount, and are clearly indicated during the order process before completion.
For more details, please consult our "Shipping" page and pay attention to what is reported in this section because the indications contained form an integral and substantial part of these General Conditions of Sale and, therefore, are considered to be fully known and accepted by you at the time of transmitting the order form.
7. RIGHT OF WITHDRAWAL
Pursuant to Article 64 of Legislative Decree no. 206 of 6 September "Exercise of the right of withdrawal"
For distance contracts and contractual proposals or those negotiated outside business premises, the consumer has the right to withdraw without any penalty and without specifying the reason, within a period of ten working days. This right may be exercised exclusively in Italian territory and only by natural persons; it is therefore not valid for customers purchasing with a VAT number.
7.1 METHODS
- Send a communication to the email address info@dianashop.it within 14 days of goods delivery, stating the wish to withdraw from the contract. This communication must contain the order reference number.
- The refund will be made using the same method used for the purchase.
- Carefully prepare the package and ship it as soon as possible and within 7 days of exercising the right of withdrawal, to the following address:
The return will be at the customer's expense and under their complete responsibility until it reaches our warehouse.
Diana Shop is in no way responsible for damage or theft/loss of returned goods.
No parcels will be accepted COD or freight collect under any circumstances.
7.2 WHEN THE RIGHT OF WITHDRAWAL EXPIRES
- For even partial use of the product or in the absence of its components (tags, accessories, labels, and seals);
- For damage to the product (adhesive tape, staples, etc...)
- In the absence of the external packaging and original packaging;
In such cases, Diana Shop will return the item to the sender, charging the shipping costs to the sender.
7.3 REFUND TO THE CUSTOMER
Once the goods have been received and their integrity verified, we will immediately process the refund within 48 hours using the payment method used for the order.
The amount that will be credited will be the actual amount paid. (for items costing more than €99, while for items costing less than €99, €5 will be deducted corresponding to the shipping costs incurred by the customer for receiving the goods).
* (For refunds of cash on delivery purchases, collection fees of €5 will be deducted)
8. APPLICABLE LAW AND DISPUTE RESOLUTION
The General Conditions of Sale are governed by Italian law and, in particular, by Legislative Decree 6 September 2005 no. 206 on distance contracts and by Legislative Decree 9 April 2003 no. 70 on certain aspects concerning electronic commerce. In the event of disputes between the owner and each end-user, arising from the General Conditions of Sale, the competent court is that of Lanciano (CH).
9. MODIFICATION AND UPDATE
The General Conditions of Sale are modified from time to time also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on www.dianashop.it.
